TERMS, CONDITIONS, AND NOTICES
AGREEMENT BETWEEN CUSTOMER ("YOU") AND INTERLINE TRAVEL & TOUR, INC. D/B/A Interline Vacations or perx.com.(PERX)
Travel services are offered to you, the customer, conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. Payment for our travel services constitutes your agreement to all such terms, conditions, and notices.
Prices: All prices quoted are based upon double occupancy, two (2) persons sharing room or cabin, unless otherwise noted. All prices are subject to availability and prior sale and may be withdrawn or changed at any time. PERX is not responsible for typographical errors. Unless noted otherwise, transportation, passport and visa fees, departure taxes, items of personal nature, optional activities, tours, and gratuities are not included.
Cruise/Tour Reservations: Deposits, payment timelines, and cancellation or change fees vary from cruise line to cruise line and even sometimes within one cruise line based upon duration or destination. Please ensure that you adhere to the timelines as provided on your confirmation documentation. Changes or cancellations to a confirmed and deposited reservation may incur penalties that are charged by the cruise line or tour operator. Any refunds of unused portions of a trip will be made in accordance with the terms & conditions of the travel supplier who received your payment.
Resort/Hotel Reservations: A deposit of at least $100 per person is required to make a reservation. Full payment is due no later than 30 days prior to travel. Payment in full is required at time of booking for all online bookings. Cancellations or changes to a confirmed reservation are subject to availability and to any penalties that are charged by the resort or other suppliers. When booking a resort you acknowledge that you have read and understand the cancellation policies and other terms and conditions of the resort/hotel.
If you cancel or otherwise change your reservation, all amounts paid, after cancellation penalties charged by the hotel or resort, if any, (PERX Credit) may be applied in full toward the purchase of future hotel, cruise or tour reservations provided that credit is requested within one (1) year of the original date of travel (except online bookings-see below). Alternatively, at your discretion, you may request a refund, in which case the amount of the PERX Credit described above will be refunded to you. All requests for refunds should be made in writing and will be processed within 5-7 days. For online bookings a refund will automatically be made to your credit card within 5-7- days.
Free Cancellation: Many of our resorts/hotels offer free cancellation. In those cases, if you cancel your reservation for any reason the resort will not charge any penalty. However, if you want to book another trip at the same resort at a different time the rate can be higher or lower than the original rate of the cancelled reservation. PLEASE NOTE: Not every resort/hotel offers Free Cancellation in which case each resort's/hotel’s change/cancellation rules will apply. Please ask your booking agent to verify if the property you selected offers Free Cancellation Waiver or if booking online read the cancellation policy carefully before booking. Free Cancellation is not available for cruises or tours. International Cardholders: All charges and refunds are in US Dollars. If a foreign currency card is used for booking, when the transaction is refunded, the exchange rate for the refund may not be the same as the rate used when the original purchase was processed. As a result, the amount of the purchase and the refund may differ. If the amount of the refund is less than the amount of the purchase, the cardholder is responsible for the difference as per the terms of their cardholder agreement.
Proof of Citizenship: Proof of citizenship, visas, vaccinations, and passport requirements are customer's complete responsibility. Depending on customer's destination, customer is required to have a passport, visa(s), and relevant documentation of current vaccinations. Customer is instructed, advised, and required to complete research with enough advance preparation to obtain the necessary documentation to travel to, through, and stay in each destination planned as part of customer's itinerary. Remember there are rules unique to minors traveling. Minors require their own documentation, and requirements vary according to the type of travel, whether domestic or international, and even by supplier.
Travel Destinations: Although statistically most travel is completed without incident, travel to certain destinations may involve greater risk than others. Covid 19 has greatly increased this risk. PERX urges passengers to review travel prohibitions, warnings, announcements, advisories, and relevant vaccinations/testing requirements issued by the United States Government and others prior to booking travel to certain destinations. Information on conditions in various countries and the level of various risks associated with travel to particular international destinations can be found at www.state.gov, www.tsa.gov, www.dot.gov, www.faa.gov, www.cdc.gov, www.istm.org, www.tripprep.com, and www.customs.gov.
Transportation: Transportation to and from customer's destination is the responsibility of customer. In many cases PERX makes available a website where transfers can be purchased.
Eligibility / Airline Employment: Verification of customer's eligibility for reduced rate benefits is required prior to the release of any travel documents. Eligibility varies by supplier and it is customer's responsibility to provide whatever is required by the supplier(s). PERX is not liable for any penalties and/or forfeitures based upon customer's inability to verify eligibility in a timely manner in advance of the anticipated travel. Proof of eligibility must also be available for inspection upon check-in for all travel.
Travel Insurance: PERX strongly recommends the purchase of travel insurance to cover any unforeseen medical or other travel issues and to protect your trip investment.
Itinerary/Supplier Alterations: All suppliers reserve the right to change the itinerary without prior notice. In the event of a reduction in services provided or a change to a hotel at a lower rate than the type included in the tour, a proportionate refund will be made at the discretion of the tour operator(s) or cruise line. In the event customer's hotel is oversold upon arrival, the hotel reserves the right to accommodate customer at an equivalent or better property with no further liability to PERX.
Express Notice of Agency: PERX is headquartered in Austin, Texas. PERX ACTS AS THE DISCLOSED AGENT FOR THE CARRIERS, HOTELS AND OTHER SUPPLIERS IN THE CHAIN OF TRAVEL PROVIDING TRAVEL OR OTHER SERVICES FOR THE CUSTOMER, AND DOES NOT CONTROL SAID SUPPLIERS ON WHOSE BEHALF WE MARKET. PERX AND ITS AFFILIATES ARE NOT LIABLE FOR THE ACTS, ERRORS, OMISSIONS, REPRESENTATIONS, WARRANTIES, BREACHES OR NEGLIGENCE OF ANY SUCH SUPPLIERS OR FOR ANY PERSONAL INJURIES, DEATH, PROPERTY DAMAGE, OR OTHER DAMAGES OR EXPENSES RESULTING THEREFROM. PERX AND ITS AFFILIATES HAVE NO LIABILITY AND WILL MAKE NO REFUND IN THE EVENT OF ANY DELAY, CANCELLATION, OVERBOOKING, STRIKE, FORCE MAJEURE OR OTHER CAUSES BEYOND THEIR DIRECT CONTROL, AND THEY HAVE NO RESPONSIBILITY FOR ANY ADDITIONAL EXPENSE, OMISSIONS, DELAYS, RE-ROUTING OR ACTS OF ANY GOVERNMENT OR AUTHORITY. IN NO EVENT SHALL PERX AND ITS AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF, OR IN ANY WAY CONNECTED WITH ANY INFORMATION, PRODUCTS, AND SERVICES OBTAINED THROUGH TRAVEL SERVICES PROVIDED BY PERX, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, SUCH AS BUT NOT LIMITED TO THEFT, LOSS, DELAY OR INCONVENIENCE, LOS OF ENJOYMENT, LOSS OF PAY, UPSET, DISAPPOINTMENTS, DISTRESS, MECHANICAL BREAKDOWNS AND/OR MALFUNCTIONS, GOVERNMENT ACTIONS, STRIKES LOCKOUTS, WAR, DECLARED OR UNDECLARED, TERRORISM, WEATHER, ACTS OF GOD, OR OTHER FACTORS, EVEN IF PERX, AND/OR ITS AFFILIATES, HAVE BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. PERX HAS SOLELY RECEIVED A COMMISSION AND PERHAPS AN ADMINISTRATIVE FEE FOR ANY CRUISE OR TOUR BOOKING, AND CUSTOMER AGREES AND UNDERSTANDS THAT ANY RECOVERY FROM PERX IS LIMITED TO THE COMMISSIONS AND ADMINISTRATIVE FEES ACTUALLY RECEIVED BY PERX. REGARDING RESORT/HOTEL BOOKING(S), PERX ENTERS CONTRACTS WITH INDIVIDUAL PROPERTIES, AND RESELLS HOTEL SPACE TO CUSTOMERS. CUSTOMER AGREES AND UNDERSTANDS THAT ANY RECOVERY FOR A HOTEL BOOKING FROM PERX IS LIMITED TO THE AMOUNT ACTUALLY RECEIVED BY PERX. PAYMENT FOR TRAVEL SERVICES CONSTITUTES YOUR CONSENT TO THE TERMS & CONDITIONS HEREIN. SAID TERMS CANNOT BE AMENDED WITHOUT THE AMENDMENT BEING IN WRITING AND SIGNED BY AN AUTHORIZED OFFICER OF PERX. PERX AND ITS AFFILIATES, MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY OF THE INFORMATION, PRODUCTS, AND SERVICES CONTAINED ON ITS WEB SITE, BROCHURES, AND/OR OTHER TRAVEL OFFERINGS FOR ANY PURPOSE, AND THE INCLUSION OR OFFERING FOR SALE OF ANY PRODUCTS OR SERVICES DOES NOT CONSTITUTE ANY ENDORSEMENT OR RECOMMENDATION OF SUCH PRODUCTS OR SERVICES BY PERX, OR ITS AFFILIATES. ALL SUCH INFORMATION, PRODUCTS AND SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. PERX AND ITS AFFILIATES HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, PRODUCTS, AND SERVICES, INCLUDING ALL IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NONINFRINGEMENT.
This agreement is governed by the laws of the State of Texas, USA. Customer hereby consents to the exclusive jurisdiction and venue of courts in Travis County, Texas, USA, in all disputes arising out of or relating to the use of the services of PERX. Use of PERX travel services is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including, without limitation, this paragraph.
Seller of Travel: PERX is a registered seller of travel in Florida, California, Hawaii, and Washington. See our website for relevant registration information.
Miscellaneous: PERX performance of this Agreement is subject to existing laws and legal process, and nothing contained in this Agreement is in derogation of the right of PERX to comply with law enforcement requests or requirements relating to customer's use of the PERX website and/or information provided to or gathered by PERX with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and agreement shall continue in effect. This Agreement (and any other terms and conditions referenced herein) constitutes the entire agreement between the customer and PERX with respect to the sale of travel services, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the customer and PERX with respect to our sale of travel services. A printed version of this Agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this Agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
MODIFICATION OF TERMS & CONDITIONS: These Terms & Conditions are subject to change without notice and other restrictions may apply. PERX reserves the right to change the terms, conditions, and notices under which these Terms & Conditions are offered and customer agrees to accept and be bound by those terms, conditions, and notices that are in effect at the time of customer's use of the travel services of PERX.
